Registration of divorce in Hungary

All Hungarian citizens whose marriage was dissolved by a foreign court must have the divorce registered in Hungary.

In person, by appointment for 'Registration (divorce)', the procedure is free of charge.

Documents required for the registration in Hungary of a marriage contracted in Hungary and dissolved abroad:

- Application form completed but not signed;
- Identity documents (passport, identity card);
- Hungarian marriage certificate (original or copy);
- Brussels IIa Regulation (for divorces after May 1, 2004) in Dutch: Certificaat betreffende beslissingen in huwelijkszaken, bedoeling artikel 39 (1). Decision number and availability: L338/16 NL publicatieblad van Europese Unie 23.12.2003. (can be obtained from a lawyer or court) - the form required in Hungarian language;
- Original Dutch court decision on divorce (and declaring it final); "Beschikking",  certified translation: https://www.ngtv.nl/.


PLEASE NOTE: The divorce decree will only be accepted if it has been certified by OFFI or by certified translators working in the relevant language area. Please also note that only direct translations are accepted; documents translated via an intermediary language (e.g., a document translated from Arabic into Dutch and then from Dutch into Hungarian) are not acceptable.

Who can initiate the procedure?

The application may be submitted by the Hungarian citizen spouse.

If you have not yet registered your previous marriage in Hungary, you must first initiate the registration procedure for your previous marriage at the same time when you register your divorce (in this case, you need to book two appointments for each type of case).

Duration of procedure

The process may take up to 6-8 months. There is no possibility of expediting the process.
